A Guardian ad Litem (GAL) is a trained volunteer appointed by the court in Vermont CHINS (CHildren In Need of care and Supervision) cases. The GAL acts as an independent parental advisor and advocate whose goal is to safeguard the child’s best interests and rights. From the GAL program mission statement, we want to “..make certain these children and their families receive appropriate services in a timely manner; that case plans, and court decisions are based on the best interests of the child; and that every child has a safe, stable, and permanent home within a reasonable period of time.” The GAL’s role is defined in Rule 6 of the Vermont Rules for Family Proceedings, and the court order appointing us gives us access to the child and certain confidential records.
What GALs Do
Our primary duty is to be a consistent, trusted adult in the child’s life during the time they are involved with the court. We see them at least once a month and are available to address any questions or worries. We work closely with the child’s attorney, DCF, school, foster parents, and other providers to ensure the child’s needs are met.
GAL Duties and Responsibilities
Information Gathering
We objectively examine the situation, including the relevant history, environment, relationships, and needs of the child. To do this, we talk to anyone who knows the child, such as school staff, family, and others who may have information. We will also review the child’s DCF file, school records, and relevant court or law enforcement records. It’s important to note that GALs do not have any input to the court on if the alleged actions happened, and we are not investigators. Our purpose in gathering information is to know the child and their situation as fully as possible so we can effectively advocate and make the best possible recommendations.
Advocacy
We attend hearings, DCF meetings, school meetings, and other meetings about the child to advocate for the child’s best interest. We ask questions and make suggestions regarding the child’s care, education, and other services provided. We work with the child’s attorney to ensure the judge has the information needed to make well-informed decisions regarding the child.
Monitoring
We track the orders of the court and the DCF case plan to monitor the progress of all parties. We frequently communicate about the child with the DCF, foster parents, and school staff. We work closely with the child’s attorney and are required to report to the court if the child is not being effectively represented.
